PREMISES LIABILITY

PALM BEACH CIRCUIT COURT

A man who fractured a knee in a fall at a Boca Raton gasoline station recovered nearly $80,000 in his lawsuit.

Kevin Sheehan, 52 in May 2013, visited a gasoline station during a rainstorm. He slipped and fell on a tile surface outside the station's convenience store. Sheehan's trial attorney contended mats should have been placed on the tile and a warning should have been posted for slippery conditions.

The defense blamed Sheehan, claiming no prior accidents occurred on the tile and he failed to watch his step. The jury evenly split liability, so its award was halved to $79,473.
