PREMISES LIABILITY

VOLUSIA CIRCUIT COURT

A jury awarded more than $1 million to a man who claimed he suffered a concussion and a spinal-disc herniation in a fall in a Burger King restroom.

Timothy Hajdasz, who was in his 50s at the time of the July 2015 incident, claimed he slipped in a puddle caused by a leak.

Although a former employee claimed leaks had been a recurrent condition, the defense contended the restaurant staff had not been aware of a leak and the former employee was not working on the date of the accident. The jury found the restaurant liable and awarded Hajdasz almost $1.2 million.
