MOTOR VEHICLE

PUTNAM CIRCUIT COURT

A jury cleared a motorist who headed into oncoming traffic and a collision trying to avoid hitting a deer on a Putnam County road in 2015.

The lawsuit filed by the other motorist and a passenger of the vehicle that encountered the deer alleged the motorist who avoided the deer overcorrected after missing the animal and then crossed the center line. One of the plaintiffs suffered ankle fractures, and the other claimed she suffered spinal injuries.

At trial, the defense contended the defendant acted reasonably and should not be held liable for entering the oncoming traffic lane. The jury agreed.
