PREMISES LIABILITY

MIAMI-DADE CIRCUIT COURT

A jury awarded nearly $240,000 to a man who slipped on liquid and fell in the dairy aisle at a Homestead supermarket in November 2017.

Carlos Caamano, a 29-year-old deliveryman, claimed he suffered herniations of two spinal discs and an injury to his left shoulder. He underwent decompressive surgery that addressed his spine and left shoulder, and he claimed he suffers ongoing pain and limitations that will worsen.

The defense contended Caamano fell because he was texting and not watching his steps. The jury assigned 75 percent of the blame to the supermarket and 25 percent to Caamano, reducing the original $319,120 award.
