PREMISES LIABILITY

BROWARD CIRCUIT COURT

A robbery victim who was shot three times and lost a leg reached a $1 million settlement with the owner of a market where he was robbed after making a purchase.

Dennis Barker, 28 at the time of the July 2018 incident, was shot in the abdomen. He suffered severe blood loss that necessitated amputation of his left leg. Barker sued, alleging the store on U.S. 441 west of Fort Lauderdale Executive Airport had a history of robberies in a high-crime area but did not hire a security guard or limit its hours of operation.

The parties negotiated a settlement before depositions and the defendant's insurer agreed to tender its $1 million policy.
