negligence lawsuit against Cornell University in the fraternity hazing death of a Coral Gables teenager will go forward after a judge denied a dismissal motion arguing the case would be “profoundly counterproductive” to the school’s anti-hazing program.

Tompkins County, New York, Supreme Court Justice Gerald Keene turned back the university’s position in a decision detailing the the death of 18-year-old freshman Antonio Tsialas, whose body was found in a gorge two days after his disappearance from an unsanctioned Phi Kappa Psi party.
