A lawsuit by billionaire auto mogul Norman Braman and real estate baron Jorge Pérez to stop a gambling venture planned in Miami's predominantly residential Edgewater neighborhood survived a dismissal motion minus some counts.

Miami-Dade Circuit Judge Michael Hanzman shot down some of the arguments offered by the city and developer West Flagler Associates Ltd. but agreed with the city that claims over city letters "raise no 'justiciable question' ripe for adjudication."
