The U.S. Court of Appeals for the Eleventh Circuit reversed a federal bankruptcy court’s decision to authorize a debtor to receive Paycheck Protection Program funding under the CARES Act, guaranteed by the Small Business Administration.

And James D. Silver, a partner at Kelley Kronenberg’s Fort Lauderdale office who is not involved in the litigation, said the ruling by the federal appeals court could be complicated if the coronavirus relief legislation passed by Congress this week is signed into law by President Donald Trump, or if Congress overrides a presidential veto.
