A prominent Miami real estate developer’s appeal against her former Buchanan Ingersoll & Rooney attorneys was rejected Wednesday by the Third District Court of Appeal, which affirmed a trial court’s ruling in favor of the firm in a legal malpractice suit. 

It’s a ruling that discourages litigants from attempting to alter their legal position in order to defeat a summary judgment, as the panel rejected the plaintiff’s request that she be allowed to bring amended claims, stating that doing so would “advance new issues that contradict her prior unsuccessful theories.”
