Clyde & Co. filed a complaint for declaratory relief Monday in Florida Southern District Court on behalf of Kinsale Insurance. The suit names 2210 N. Australian Avenue and Charles Sutton Jr. as claimants. The case is 9:21-cv-81978, Kinsale Insurance Company v. 2210 N. Australian Avenue, LLC f/k/a Josephs Village et al. The underlying cases involves Sutton, who filed suit against an independent living senior apartment complex after allegedly slipping and falling in his apartment. The insurer claims the fall happened after Sutton's policy had been cancelled.
