Elderly people walking awat hand in hand. Attorneys at Armstrong Teasdale and SmithAmundsen on Friday removed a class action against Florida-based timeshare marketer Westgate Resorts and Rozell Engineering to Missouri Western District Court. The complaint was filed by Montgomery & Newcomb on behalf of those who purchased lots in an inaccessible subdivision.

The complaint accuses Westgate of employing predatory sales tactics in order to pressure the elderly and others to purchase lots. According to the suit, the lots are not street accessible and the defendants have failed to construct roads or secure utility services for the area. The case is 6:21-cv-03288, Ocepek et al v. Rozell Engineering Co. et al.
