Morgan & Morgan attorney Spencer Payne won a $2 million arbitration award for the surviving children of Carolyn Deriso, who died after falling at an assisted living facility in 2018.

“I think this case is very important because nursing homes and living facilities have a smaller legal community, and there is that understanding or belief that when you go to arbitration a seven-figure verdict is off the table,” Payne said. “That’s why these facilities have these arbitration agreements, almost all of them have it listed in their contracts. They think their chances are better, and if they lose they aren’t going to get hit with a seven-figure verdict.”
