Sam's Club, the retail warehouse store chain, and its parent company Walmart filed a patent infringement action Tuesday in Florida Middle District Court against BJ's Wholesale Club Holdings Inc. The suit, brought by DLA Piper, asserts four patents related to mobile and virtual self-service checkout tools. Counsel have not yet appeared for the defendants. The case is 6:22-cv-00587, Sam's West Inc. et al v. BJ's Wholesale Club Holdings, Inc.

The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays.
