Ari C. Shapiro and Andrew R. Schindler of Gordon Rees Scully Mansukhani have entered appearances for Texas Medical Technology LLC and CEO Omri Safran in a pending defamation lawsuit related to high demand for COVID-19 tests during the surge of the Omicrom variant. The suit was filed March 9 in Florida Southern District Court by Benjamin L. England & Associates on behalf of DermaCare Packaging & Private Label, distributor of Flowflex COVID-19 Antigen Home Tests.

According to the suit, the defendants promised their customers unrealistic delivery windows for COVID tests and then blamed DermaCare for delays. The case, assigned to U.S. District Judge Donald M. Middlebrooks, is 9:22-cv-80369, Stone et al v. Safran et al.
