A jury awarded a total of $150,000 to a mother and son for damages resulting from extermination work in their residence.

On Jan. 20, 2016, plaintiff James Upson was poisoned by rodenticide that an exterminator had sprayed. The incident occurred at an apartment that was located at 1015 Spanish River Road, in the city of Boca Raton. Upson and his mother, plaintiff Dianne Upson, shared the residence. The rodenticide was sprayed in several areas, including a bedroom in which James Upson was asleep. Dianne Upson was not injured, but the rodenticide also killed the family cat.
