What are some of the department’s most satisfying successes of 2021, and why?
Our most satisfying work in 2021 involved nationwide battles in which hospitals and emergency room physicians are increasingly having to fight major health insurers for systematically denying and underpaying for ER services. For example, our firm represented three TeamHealth-affiliated emergency physician groups in litigation against United Healthcare and its affiliates for underpayment of out-of-network emergency services. After a 15-day trial in Nevada state court, the Lash & Goldberg team, together with co-counsel, secured a $62.65 million jury verdict in December 2021 for our clients. This was a closely-watched case, raising important nationwide industry issues regarding the proper reimbursement for out-of-network hospital services provided by emergency room physicians. Emergency departments are required by law to treat all patients, regardless of insurance status or ability to pay.
