The median jury verdict in the past five years is 79.5% greater than the median verdict spanning the earlier period of 2001 to 2005. For mediated settlements, the contemporaneous increase has been 90%. For non-mediated settlements, it has been a mere 7.5%.

VerdictSearch released new intel that showed mediated settlements are growing in dollar amounts at a pace far greater than non-mediated settlements, as well as the verdicts juries returned in civil trials.
Anthony Torrente, a partner and mediator with Hinshaw & Culbertson in Miami, said that one of the tactics used by plaintiff lawyers that could be driving this trend is citing the verdicts that juries returned in their cases or in those of their competitors, as the baseline during the mediation.
