On Nov. 6, 2018, plaintiff Maude Louis, a 64-year-old unemployed woman, fell while she was traversing a sidewalk that abutted Fifth Avenue North, between 10th Street North and 11th Street North, in Naples. She claimed that she suffered injuries of her back, a leg, her neck, her pelvis, a shoulder and a wrist.

Louis sued the sidewalk's maintainer, the city of Naples. The lawsuit alleged that the city was negligent in its maintenance of the sidewalk. The lawsuit further alleged that the city's negligence created a dangerous condition that caused Louis' fall. The matter proceeded to arbitration.
