James R. Foster of Wicker Smith O'Hara McCoy & Ford has entered an appearance for the manager of a South Florida shopping plaza in a pending breach-of-contract lawsuit brought by grocery chain Kroger. The suit, filed Sept. 9 in Florida Southern District Court by Nicklaus & Associates, accuses 1045 LLC of breaching its obligation to indemnify Kroger in two lawsuits arising from conditions at the property. The case, assigned to U.S. District Judge Donald M. Middlebrooks, is 9:22-cv-81349, Topvalco et al v. 1045, LLC.
