Litigation over the right of Miami Beach restaurants and bars to place seating areas for guests on the sidewalk has resulted in a ruling that underscores how much power the city has to control the way private businesses use public spaces.

The ruling from a Miami-Dade Circuit judge was a win for Carlton Fields shareholders Enrique Arana and Scott Byers, who represent Miami Beach.
