A portion of a legal malpractice suit can proceed with a “due diligence checklist” allegation against two attorneys and a Florida law firm after the First District Court of Appeals recently held that the statute of limitations had not run in an underlying contractual dispute.

In March 2021, Peter Von Dyck filed the instant complaint against attorneys Richard Kyle Gavin and John Albert Carlisle and the law firm of Liles, Gavin & George, alleging malpractice during their representation of him and his company, Zassi, in an underlying liability trial brought by Hollister Inc. in the U.S. District Court for the Middle District of Florida.
