"The photographic evidence produced did not definitively disprove Mr. Del Rio's testimony," Judge Thomas Logue wrote for the court. "Rather, when Mr. Del Rio's testimony and the photographic evidence at issue are taken together, it is clear they present an issue of fact for a jury to decide."

A Florida appellate court reversed a summary judgment award in favor of an engineering company, finding that a genuine issue of material fact still exists about the location of a manhole cover a Florida man struck where the company was performing work.
The Third District Court of Appeal reversed a summary judgment award to Russell Engineering last week for a negligence and premises liability claim brought by Nermy Del Rio.
