Gov. Ron DeSantis signed Senate HB 761 into law on May 25. This new law provides highly sought-after reforms to Florida’s Telephone Solicitation Act (FTSA). After coming into effect on July 1, 2021, the FTSA yielded an immediate wave of frivolous class action lawsuits against all types of business communicating to Florida residents about their products and services.

A violation of the FTSA brings penalties of $500-$1,500 per call or text in addition to liability for attorneys’ fees and costs. With millions of calls being placed since 2021, companies being sued under the FTSA were finding themselves in the cross-hairs of devastating class action risk. The Florida legislature took notice. By the time HB 761 was introduced in the House over 500 putative class actions had been filed.
