Amid a boom in residential construction, community associations (associations) must be cognizant of the pitfalls that arise from defective construction. The rapid rate of construction—coupled with a lack of proper supervision by general contractors and supply and labor challenges—is problematic, and its costs will spill over to associations if they are not vigilant and proactive.

Construction defects are expensive to repair and can also lead to serious safety concerns if not promptly addressed. Construction problems can occur in brand-new construction and older properties managed by associations. Fortunately, by staying informed about the situation and the mechanisms to address defects, HOAs can avoid costly pitfalls.
