The Legal Landscape Transforming Digital Divorce

The landscape of divorce law has undergone significant changes, creating a conducive environment for the rise of digital divorce platforms. Two major legal trends in Florida exemplify this transformation: the shift toward equal time-sharing and the overhaul of alimony laws.

In July 2023, Florida implemented a massive overhaul of alimony laws and a modification of the presumption regarding time-sharing. Previously, courts had no presumption in favor of or against any particular time-sharing schedule. Now, there is a presumption in favor of equal time-sharing.

This means that if one parent wants an unequal arrangement, they must prove why equal time-sharing would not be in the best interest of the children. There is a significant economic impact on this presumption. This shift has reduced litigation as many parents are dissuaded from taking on the burden of proof, even though I would argue that a one-size-fits-all approach doesn't work for all families, particularly those with special needs children.
