Lawyers for women and children videotaped by a voyeur while on a cruise ship have moved to certify a class against Royal Caribbean, citing the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act.

Tuesday’s motion, filed by Adam Moskowitz, of the Moskowitz Law Firm in Coconut Grove, seeks to certify a class of about 960 passengers who, on a dozen different trips of the Symphony of the Seas cruise, from Dec. 1, 2023, to Feb. 26, 2024, were videotaped by a crew member without their knowledge while undressing in the cabin bathrooms. The crew member, Arvin Joseph Marisol, a citizen of the Philippines, pleaded guilty to child pornography and was sentenced to 30 years in federal prison.
