A fax in a wrongful termination case has a slim chance of making it into evidence, and a fired employee’s attorney may be on his way out of the case under a 4th District Court of Appeal ruling.

Patricia Jacobson was associate director of the University School Middle School in Davie when she thought she was being set up for dismissal. She was at the school’s fax machine receiving papers on a health insurance claim in 2005 when she found a fax to the headmaster and others saying she didn’t have enough performance issues to be fired.
