Twenty-three plaintiffs’ lawyers lined up against a wall in a federal courtroom in San Diego, awaiting their turn to argue about where to try dozens of cases related to sudden acceleration problems in Toyota vehicles. The rest of the courtroom was standing room only, with lawyers spilling out into the hallway.
The first to speak was Toyota’s lead counsel, Cari Dawson, chairwoman of Alston & Bird’s class action practice team and a partner in Atlanta. She argued the Central District of California makes sense, given that Toyota’s subsidiary, Toyota Motor Sales USA, is based in Torrance, Calif. “Toyota Motor Sales is named in every single one of these lawsuits,” she said. That subsidiary, she said, is responsible for sales and marketing, as well as for the recalls. “In addition,” she said, “Japan is going to play a critical role.”
