The bankruptcy trustee for Scott Rothstein’s defunct law firm has sued his former accounting firm for allegedly failing in its fiduciary duty to oversee the firm’s finances and stop his $1.2 billion Ponzi scheme.
The lawsuit filed by trustee Herbert Stettin late Wednesday accuses Berenfeld Spritzer Schechter & Sheer of aiding and abetting, negligence and breach of fiduciary duty. Berger Singerman attorney Chuck Lichtman, who filed the suit on behalf of Stettin, said the bankruptcy estate would seek millions of dollars in compensatory damages.
