When it came to exposing fraud in Scott Rothstein’s Ponzi scheme, Gibraltar Private Bank & Trust had no duty to act and no duty to speak, bank attorney Thomas Tew argued Thursday.

He was trying to persuade Broward Circuit Judge Jeffrey Streitfeld to dismiss the bank from a civil lawsuit brought by investors claiming more than $60 million in losses in Rothstein $1.2 billion settlement financing fraud.
