During the recent economic downturn, employers increasingly have entered into and enforced restrictive covenants, such as noncompete and nonsolicitation agreements, to prevent key employees from moving to competitors or opening competing businesses.
In Florida, these agreements are governed by Section 542.335 of the Florida Statutes. When drafting a restrictive covenant, or deciding whether to litigate a violation of one, it is crucial for employers to understand this statute.
