A March 18 article about the outcome of a shopping center commission dispute incorrectly reported that attorney fees in the amount of $2.5 million and accounting fees in the amount of $350,000 were included in a final judgment issued by Palm Beach Circuit Judge David Crow. The article also incorrectly reported the money was to be divided by the law firms of Greenberg Traurig and Becker & Poliakoff. In fact, the judgment in favor of the plaintiff Delray Property Investments awards $144,000 in damages plus interest from Aug. 9, 1993, not $3.4 million as reported. In his order, the judge “reserves jurisdiction to award attorney’s fees and costs, if any, including the costs associated with the accounting work performed” by a court-appointed expert. Both sides plan to petition the court for fees and costs. The defense has filed a motion for rehearing, to vacate the final judgment as premature and to set a counterclaim for trial. The Review apologizes to the Sweetapple Broeker & Varkas firm and its client for the errors.

In one of the longest-running lawsuits in Palm Beach County, a dispute over an unauthorized $144,000 broker’s commission produced a decision that potentially could be worth nearly $3.4 million in damages, interest, fees and costs.
