In a move that could backfire disastrously for human rights plaintiffs or ultimately expose their targets to massive liabilities, the question of whether the Alien Tort Statute applies to corporate defendants has finally been placed before the U.S. Supreme Court.

In a 53-page petition for certiorari filed Monday, lawyers for a group of Nigerian plaintiffs argue that the 2nd U.S. Circuit Court of Appeals improperly restricted the law’s reach last year when it ruled corporations cannot be held liable for violations of international law under the statute.
