Capital One Financial has sued John Kanas, chief executive of the Miami Lakes-based bank, alleging breach of contract. The lawsuit, filed on Thursday in the U.S. District Court for the Eastern District of Virginia, claims Kanas violated a noncompete agreement with McLean, Virginia-based Capital One when BankUnited agreed in June to pay $71.4 million for New York-based Herald National Bank. The Herald National acquisition would mark the first step in BankUnited’s long-anticipated move into New York.
Kanas, through a BankUnited spokeswoman, declined comment.
