A laborer whose right foot was crushed in a backhoe accident received a $475,000 settlement.

In 2007, Hector Sosa, then 33, was working near a backhoe operated by Herbert Hinds when the bucket struck his foot. Sosa suffered lacerations, fractures to the second and third metatarsals, and a subungual hematoma of the fourth nail bed. He suffered complications including gangrene, resulting in the need to amputate his second and third toes. Plaintiff counsel claimed Hinds admitted he couldn’t see Sosa but knew he was near the backhoe. Hinds claimed he thought Sosa was a safe distance away. Defense counsel argued the accident did not rise to the level of gross negligence.
