As the 4th District Court of Appeal upheld its first award to a sick smoker Wednesday, one of the judges on the panel pleaded for more guidance from the Florida Supreme Court to end “a form of legal poker” being played in the trial courts.
The unanimous three-judge panel affirmed a $600,000 award to Jimmie Lee Brown, the widow of Roger Brown, in a case against R.J. Reynolds Tobacco.
