Palm Beach Gardens-based Bankrate cannot use a contract clause to avoid fraud claims in a buyout that culminated in a giant technical glitch, a state appeals court ruled.

“This opinion restarts the Lower Fees v. Bankrate litigation, which for three years has never advanced beyond the pleading stage,” said Beverly Pohl, a partner at Broad and Cassel in Fort Lauderdale and Lower Fees’ appellate attorney.
