The result of the Appellate Division, Third Department, decision is that the Tioga County Department of Social Services apparently will have to retry a child neglect case against a registered sex offender with children from two women, both of whom he is accused of abusing in the presence of children while also using marijuana.

The court said that attorney Mark C. Gugino of Spencer, Tioga County, did such a poor job representing the man—and went so far as to threaten to withhold information if the client changed attorneys—that a new hearing is required. It also removed the trial judge, Tioga County Family Court Judge Vincent Sgueglia (See Profile), from the case.
