The Miccosukee Tribe has filed a malpractice suit against its former general counsel, Dexter Lehtinen, claiming he gave them faulty advice on federal income tax liability for members of the tribe.
The lawsuit filed Monday in Miami-Dade Circuit Court claims the former U.S. attorney and husband of U.S. Rep. Ileana Ros-Lehtinen advised tribe members that payments from the tribe were not gambling profits and were not taxable and told the tribe it did not have to withhold federal taxes on money going to tribe members.
