A cement company hit with a $6.6 million personal injury judgment is asking the 4th District Court of Appeal for a new trial on grounds the trial court erred in not allowing distribution of fault.

Sunrise-based Continental Florida Materials is appealing the judgment that resulted from a June 2010 jury trial. A month earlier, Broward Circuit Judge David Krathen granted summary judgment for plaintiff Harvey Kusherman on the issue of extending Fabre liability to him and the company he worked for, Stiles Construction.
