A restaurant agreed to pay $385,000 to a man who claimed he fractured his hip in an outdoor fall.
Boris Brodsky, then 71, was leaving Hanna’s Gourmet Diner in North Miami Beach at night when he tripped and fell over a curb due to the slope of a cement pathway. Plaintiff counsel contended Brodsky could not see the change in elevation because the path was over a grass slope, and patrons had to go down the slope to get to the parking lot.
