Restitution orders must be based on the victim’s loss and not on the amount of profit a defendant gained from the crime, the U.S. Court of Appeals for the Second Circuit ruled.

Addressing an issue of first impression in the circuit, the panel said Wednesday that the Mandatory Victim’s Restitution Act does not allow substituting a defendant’s gains for a victim’s loss in calculating restitution.
