In a strongly worded opinion, the Third District Court of Appeal affirmed a default judgment Wednesday based on fraud against the imprisoned developers of Empire World Towers, a pair of skyscrapers in downtown Miami that never got off the ground.
“While we are mindful of Florida’s strong public policy favoring the resolution of cases on their merits, the judiciary cannot be, and is not, impotent against those wishing to corrupt the litigation process by employing fraud and deception at every turn,” Judge Leslie B. Rothenberg wrote for a unanimous panel. Chief Judge Linda Wells and Judge Frank Shepherd concurred.
