Cohen, whose wife is County Court Judge Mardi Levey Cohen, was tried by the state Judicial Qualifications Commission in January 2011, in part for calling his wife as a witness when confronted with a motion to disqualify himself from cases handled by criminal defense attorney Stephen Melnick.
