The Home Depot and a ladder manufacturer will not have to pay $350,000 in the death of a Miami civil engineer who fell from a folding aluminum ladder, the Third District Court of Appeal ruled.

A jury decided in 2010 that the home improvement retailer and Tricam Industries Inc., maker of the 13-foot Gorilla Professional 4-in-1 ladder, were negligent in selling the ladder to Roberto Coba. The jury set more than $1.6 million in damages but said Coba was 80 percent responsible.
