When two drunken friends are fighting outside a bar, neither has a duty to prevent a third drunken friend from hitting one of them in the head with a tomahawk, the Third District Court of Appeal has ruled.
The opinion by Judge Frank Shepherd, joined by Chief Judge Linda Ann Wells and Judge Kevin Emas, reversed a $1.57 million jury award in Miami-Dade Circuit Judge Ronald Dresnick’s courtroom for tomahawk victim Dennis Dorsey of Palmetto Bay.
