A Miami-Dade circuit judge erred in dismissing a wrongful death suit against a truck driver, but the victim’s widow is asking either too early or way too late to reinstate her claims against two trucking companies, an appellate panel has ruled.

Donna Portis sued Anthony Prendergast, the owner-operator of the tractor portion of the tractor-trailer in the accident; SeaTruck Inc., Prendergast’s employer; and Genstar Inc., owner of the trailer and cargo container attached to the tractor, in 2006.
