The general manager of a family-owned Nicaraguan company that sold Danish wind turbines lacked the power to start an arbitration over disputed commission checks, the Third District Court of Appeal ruled in a split opinion.

Based on that finding, the appeals court took the unusual step of reversing Miami-Dade Circuit Judge Victoria Sigler’s confirmation of a $1.6 million arbitration award against turbine company Suzlon Energy AS of Denmark.
