Lennar Homes LLC did not deceive a Fort Myers urologist and two real estate professionals when it sold them 220 acres of undeveloped land along with an expired development permit, a Lee circuit judge ruled.

The decision by Judge Keith Kyle means Lennar Homes and U.S. Home Corp., subsidiaries of Miami-based home-builder Lennar Corp., can pursue collecting $14 million for the land instead of facing the investors’ $32 million claim.
