The state Senate version of a proposed constitutional amendment that would remove rulemaking authority of the Florida Supreme Court in death penalty appeals passed through the Judiciary Committee by a 7-2 vote.
Senator Joe Negron, R-Palm City, the bill sponsor, said the reform was necessary because the current system is "a mockery of justice" that is abused at the collateral review stage. The resulting delays have allowed some prisoners to stay on death row over 30 years, and the average stay is more than 13 years.
